This is an action to recover damages in the sum of $500, arising out of the alleged negligent and careless manner in which respondent conducted the building of a railway across the lands occupied by appellant. The complaint in the action was verified by appellant October 29,1924, and the case was brought on for trial before the court and a jury on February 25, 1925. At the trial, appellant had introduced his evidence and rested, when respondent moved for a nonsuit which was granted, and the action dismissed.
