This cause originated in the Circuit Court of Oktibbeha County and the first trial thereon was held on January 31, 1963, as cause number 10020. At the close of the evidence in this trial, counsel representing the plaintiffs entered a voluntary nonsuit without prejudice against the defendant, C. T. Pennix. Counsel representing the defendant, Mrs. J. M. Jeffreys, asked for a mistrial, which was denied, and the case was submitted to the jury against Mrs. Jeffreys alone, and a mistrial occurred since the jury could not reach a verdict.
