Appellee brought this suit against the appellants to recover the value of certain lands; the petition being, in substance, as follows:

That the defendants were engaged in the real estate business in Dallas, Tex., engaged in the business, among other things, of exchanging real estate for others. That ap-pellee, on the 1st of September, 1909, owned and was possessed of 2,888 acres of land in Angelina county, Tex., reasonably worth $18,732, and 1,406 acres in Cherokee county, Tex., reasonably worth $9,139; title to the last tract being in the estate of Susan W.
