John Fanning appeals his convictions for murder in the second degree, section 565.021, RSMo 1994, and armed criminal action, section 571.015, RSMo 1994. He was convicted a second time after his prior convictions for the same charges were reversed and the ease was remanded for a new trial. State v. Fanning, 874 S.W.2d 401 (Mo.App. W.D.1994).
