This case involves a controversy between appellant, Mark Minix, (referred to as “Mi- nix”), a purchaser of real property at a Federal Tax sale, and appellee, J.C. Mag-gard, individually and as Executor of the Estate of Sylvia Maggard, (referred to as “Maggard”), the owner of an unrecorded purchase money mortgage, covering the real property, also, co-appellee, Rachel Mus-grave, an interim owner of the real property in question.
