Plaintiep in error, Joe Arridy, defendant below, was convicted in the district court of Pueblo county upon an information charging him with the murder of one Dorothy Drain, and the jury fixed the penalty at death. He seeks a reversal of the judgment entered on that verdict.

The homicide was committed on August 16, 1936. The information was filed August 31st. Counsel was appointed for Arridy and leave was granted him to withdraw his plea of “not guilty,” and enter a plea of not guilty by reason of insanity existing at the time of the commission of the crime and since.
