On August 9, 2007 Plaintiff Veoh Networks, Inc. (“Plaintiff’) commenced this declaratory judgment action against Defendants UMG Recordings and other UMG-affiliated companies (collectively, “Defendant”) seeking a declaration of non-infringement of Defendant’s copyrights, primarily under Section 512(c) of the Digital Millennium Copyright Act (“DMCA”). 17 U.S.C. § 512(c).
