FORD ELLIOTT, Judge:
This is an appeal from the order of the Court of Common Pleas of Delaware County denying appellant’s motion to dismiss pursuant to 18 Pa.C.S.A. § 110 and the double jeopardy clause of the Fifth Amendment of the Constitution. We affirm.
Appellant and Ms. Janice Eddy were engaged to be married in 1990, but Ms. Eddy broke off the engagement in October of 1990. On January 4, 1991, appellant confronted his former fiance in her apartment complex parking lot and threatened to kill her and her nieces.
