The action is for malpractice causing the death of plaintiff’s intestate, Albert Gamradt. Plaintiff recovered a verdict, which however on appeal to this court was vacated ancj a new trial awarded. Gamradt v. DuBois, 176 Minn. 312, 223 N. W. 296. The new trial resulted again in favor of plaintiff, and defendant appeals from the order denying his motion in the alternative for judgment notwithstanding the verdict or a new trial.’
