J. G. Grisham was plaintiff in the court below, and filed a suit against J. Q1. Strange and R. L. Bufkin for damages resulting from sickness and injury to the plaintiff caused by drinking a bottle of Coca-Cola manufactured by Strange and one Pidgeon, a partnership operating a Coca-Cola bottling plant in Cleveland, Mississippi, of which R. L. Bufkin was manager hut not an owner.

It appears that about July 1, 1929, the plaintiff went to Brown drug store at Merigold, Mississippi, and pur chased the bottle of Coca-Cola, of which he had consumed about one-third, when he was called from the drug…
