Defendant Marion Vaughn appeals from jury trial convictions of driving under the influence of alcohol (DUI) and driving with a suspended license. Specifically, defendant argues that: (1) the trial judge’s remarks denied him his constitutional right to testify thereby depriving him of a fair trial; (2) the trial court’s imposition of $205 in total fines was in violation of section 5—9—1(d)(1) of the Unified Code of Corrections (the Code) (730 ILCS 5/5—9—1(d)(1) (West 2002)); and (3) he was denied a fair trial because the jury consisted of 13 persons.
