2Per curiam

These matters came before the Supreme Court pursuant to an order directed to the state and to the defendant, Arthur D’Amario III, to appear and show cause why the issues raised by these consolidated appeals should not be summarily decided.

The defendant was convicted of assault in Superior Court. He was sentenced to one year of supervised probation and a $500 fine. He has appealed from the denial of his motion for a new trial and has filed a second appeal from the denial of a second new trial motion on the grounds of newly discovered evidence.
