This is an application for leave to file a petition for a writ of mandamus to compel the settlement of a bill of exceptions in a criminal case. The petition is lengthy and contains much irrelevant matter, but the foliowing material facts appear without dispute:

A verdict of guilty was returned against petitioner in the Northern District of Georgia, on May 21, 1936, before Judge Barrett of the Southern District of Georgia, sitting by designation.
