Cora Prescott Randall, a resident of the city of Norfolk, died on July 27, 1945, and on the same day a paper purporting to be her last will and testament was admitted to probate ex parte by the clerk of the circuit court of that city.

Certain of the decedent’s next of kin appealed from the clerk’s order of probate to the Circuit Court of the city of Norfolk, which, under Code, sec. 5257, ordered a trial by a jury to determine whether the paper in question was the *287will of the decedent. There was a verdict that the document was the true will of the decedent which the trial court sustained.…
