John O. Kelly was a railroad switchman and a member of the Brotherhood of Railroad Trainmen, a fraternal beneficiary society, which issued to him a certificate stating that he was entitled to all the rights, privileges and benefits of membership and to participate in the beneficiary department, class C, of the brotherhood to the amount set forth in' the constitution, to be paid to him, or at his death to his mother.
