ORDER
DUFFY, District Judge.
This matter is before the court on Defendants RDR Insurance Services, Inc. (“RDR”) and Ralph Royster’s (“Royster”) Motion for Summary Judgment.
FACTS
This is an insurance broker malpractice action in which Plaintiff contends that De fendants negligently recommended and negligently misrepresented the financial stability of Acceleration National Insurance Company (“Acceleration”). The facts of this case, as supported by the record and considered in the light most favorable to Plaintiff, are as follows:
