Plaintiff in error, as plaintiff below, sued defendant in error, as defendant below, in the county court of Okmulgee county, for tbe sum of $325 on open account for goods, wares, and merchandise sold and delivered by plaintiff to defendant. The answer was a general denial. The facts as shown by the record were these:
