While by the complaint is presented a canse of action to recover a general balance of $16,630.24 by reason of Lee’s failure to account for all the moneys received by him as treasurer, the claim became defined by certain affidavits before trial as a suit to recover the amount of certain specific illegal payments for which the treasurer had received credit.
