ORDER

BARBADORO, District Judge.

Lumber Insurance Company (“Lumber”) has filed a declaratory judgement action seeking a determination that it has no obligation to defend or indemnify its insureds, Gerald and Kathleen Allen (“Allens”), in an underlying tort action brought against them by Kenneth and Jane Moore (“Moores”). In this Order I rule on the parties’ cross motions for summary judgment. 1
