HEANEY, Circuit Judge.

This is an appeal from the District Court’s denial of the appellant’s motion for vacation of proceedings filed pursuant to Rule 12 of the Federal Rules of Criminal Procedure.

The appellant pleaded guilty, in the United States District Court • for the District of Nebraska, to a two-count indictment alleging that he violated 50 U.S.C. App. § 462(b) (3), by knowingly destroying his Selective Service registration and classification certificates.
