Appeal by defendant from Adams, J., at September Term, 1914, of Rowast. Indictment for larceny. Tbe defendant was convicted by tbe jury, and from tbe judgment pronounced appeals to tbis Court.

Tbe prosecuting witness Petbel testified: “I am a fireman on tbe Southern Railway, and on tbe 20th day of June was paid off. I bad a new $50 bill, and I went to tbe defendant’s store at nigbt and told bim I bad a ‘pretty.’ He asked to see it. I showed it to him. be took it and went to the back part of tbe store and stayed awhile.. I called to bim to return my money. After a while he came back and gave me a $2 bill. I did not know it at the time. I found it out after I left the store. I had a $50 bill, two $20 bills, and some $1 bills in my purse when I went to defendant’s store. Did not have…
