MEMORANDUM OPINION AND ORDER

The instant case is before the Court for consideration of Defendant Cigna Insurance Company n.k.a. ACE-IME Holdings’ Motion for Summary Judgment pursuant to Rule 56 of Federal Rules of Civil Procedure. See ECF Dkt. # 26. In the instant case, Plaintiff Lloyd Chase brought a negligence claim against Defendant Adam Humrichouser and a declaratory judgment claim for uninsured motorist/underinsured motorist (UM/UIM) coverage against Defendant Cigna Insurance Company n.k.a.
