LOGAN, Circuit Judge.

Plaintiff, Glenn Hill, traded corn, pork belly, and cattle futures through the Denver office of the defendant, Bache Halsey Stuart Shields, Inc. After Hill lost nearly $50,000, he sued Bache. Hill’s amended complaint in federal district court asserted Colorado state law claims for breach of contract and breach of fiduciary duty and claims under the federal Commodity Exchange Act (CEA), 7 U.S.C. §§ 1-26, for excessive trading, unauthorized trading, and misrepresentation or failure to disclose.
