[ 1 Pro-se appellant Billy M. Hicks (Hicks) appeals the trial court's April 20, 2007, order dismissing his petition for a writ of mandamus which sought an order to compel the Department of Corrections (DOC) to exercise its discretion and respond to Hicks' grievances. The appeal was assigned to the accelerated docket pursuant to Oklahoma Supreme Court Rule 1.36(a)(2), 12 0.8.2001 and Supp.2008, ch. 15, app. 1. We issued an opinion in this matter on April 18, 2009.
