At the time the debtor’s Chapter 11 Plan of Reorganization came on for confirmation, the debtor’s counsel volunteered that there was an ongoing dispute with the Internal Revenue Service which, unless settled or resolved, could doom the plan. Although the IRS did not file an objection to confirmation of the proposed plan, the debtor chose not to proceed. Instead, he filed this motion under 11 U.S.C. § 505 for a determination of the extent of his liability to the IRS.
