This action requires the interpretation and construction of a provision of the will of Harriett E. Smoak, who died testate about the year 1887, seized and possessed of a large tract of land then situated in Orangeburg County but now in Calhoun County. The matters and things involved in the action were referred to Honorable John S. Bowman, as Special Referee, to hear and determine all questions of law and fact.
