This is an extradition case. Appellant here, relator in the court below, was arrested and taken into custody by the sheriff of El Paso County, acting under the executive warrant of the governor of this state issued upon the requisition of the governor of the State of California. Not only by virtue of the constitutional guarantee but also by virtue of the express provisions of Sec. 10 of Art. 1008a, Vernon’s C. C.
