Walter Hales, d/b/a Walter Hales Lumber & Supply Company, brought this suit against C. E. Marshall and Houston Fire and Casualty Insurance Company for materials furnished by Hales to Marshall and alleged to have been used by Marshall in the painting on a public housing project in Sweetwater, Texas under a painting subcontract.
