Action in claim and delivery. The complaint alleges, in substance, that the defendant is, and at all times mentioned therein was, the sheriff of Fergus county, Montana; that on March 21, 1903, the plaintiff was the owner of certain personal property, consisting of grain, cattle, and hogs, of the value of $750; that the defendant on March 21, 1903, without the plaintiff’s consent, wrongfully took said property from her possession; that before the commencement of the action, and on March 26th, the plaintiff demanded of defendant…
