This case is before the Court upon an appeal from a final judgment of the Circuit Court of Marshall County entered in a civil action instituted by Eugene R. White, Deputy Commissioner of Forfeited and Delinquent Lands, to sell a specific tract of land in McMechen, West Virginia.
