OPINION OP THE COURT

WATSON, J.

Appellee, pursuant to a power of sale in a mortgage executed and delivered to him by apppellant’s mother and predecessor in title, published notice of a sale of the mortgaged premises for the satisfaction of the debt — a note which the mortgage secured. Appellant sued to enjoin the sale. Demurrers to the second and third counts were sustained. Appellant declined to plead further, and judgment was entered dismissing those counts and granting but partial relief on the first.
