ORDER OF DISMISSAL

KANE, District Judge.

This is a wrongful death action charging defendant with negligence in the operation of its skiing areas. The defendant has moved to dismiss on the ground that plaintiff’s claim is barred by the applicable statute of limitations. For the reasons below this motion is granted.

C.R.S. § 13-21-204 provides that wrongful death actions must be brought within two years after the commission of the alleged negligence resulting in the death for which suit is brought or within one year after the death for which suit is brought, whichever is later. The statute of…
