Cody Lang Thomas pled guilty to theft of property valued at more than $1,500.00 and less than $20,000.00, a state jail felony. 1 He received a twenty-year sentence as the result of enhancements under Section 12.425(a) of the Texas Penal Code. Thomas appeals his sentence, arguing that because one of the prior convictions used to enhance his sentence was punishable as a state jail felony, under Section 12.35(a) of the Penal Code—even though it was actually punished as a third degree felony— use of that conviction to enhance his sentence. in this case was invalid.…
