Plaintiff alleges that he was struck by a truck owned by the Louisiana Highway Commission and driven by an employee, Edward Connally, then acting within the scope of his authority and for the use and benefit of said Commission, on September 26, 1936, at about the hour of seven o’clock A. M.; that he was walking in a southerly (later shown to be a northerly) direction three or four feet from the edge of the pavement on the east side of the highway just below the town of Opelousas.
