This interlocutory appeal arises out of an action brought by the named plaintiff, Maribeth *641Benedetto Lightowler (plaintiff),1 against Steven Bray-ton, an attorney, and the named defendant, Brayton’s professional liability insurance carrier, Continental Insurance Company (Continental),2 alleging that Bray-ton had committed legal malpractice in his representation of the plaintiff and her deceased father’s estate.
