Error is prosecuted to this court from the Court of Common Pleas of Summit county, in which court the positions of the parties were the reverse of those in which they here appear. Reference, however, will be made to them as they appeared below.

Plaintiff, Hazel D. Sladden, Admx., sought damages for the alleged wrongful death of plaintiff’s decedent, resulting from a collision between the automobile driven by plaintiff’s decedent and a truck of defend ant, asserted to have been left upon the highway in the night season without lights as required by statute.
