This suit was instituted by Chas. Graham in the district court of Cooke county on July 29, 1927, against T. L. Gaston and wife, Imo C. Gaston, and the Continental Oil Company, the Shasta Oil Company and the Almore Oil Company. The plaintiff Graham alleged, and the undisputed facts show, that T. D. Gaston and wife, on the 1st day of January, 1926, executed their promissory note, payable to the plaintiff on November 1, 1926, in the sum of $4,000, which, together with the interest and attorney’s fees as therein provided, aggregated, at the date of the trial, $4,881.03.
