MEMORANDUM OPINION GRANTING DEFENDANT’S MOTION FOR SUMMARY JUDGMENT

The above ease came before the Court on the defendant’s motion for summary judgment filed on August 1, 2006, in response to the debtor-plaintiffs complaint alleging the creditor-defendant violated the automatic stay [i.e. 11 U.S.C. § 362(a)] by cashing the plaintiffs check after she filed a petition for relief under Chapter 13 of the U.S. Bankruptcy Code.
