Action by appellee (plaintiff below) against appellant (defendant) for injuries sustained while in defendant’s employ.
The evidence tends to show that on August 25, 1907, defendant employed plaintiff in its printing establishment as janitor, and that among other duties assigned him was that of daily sweeping out a room known as the ad” room, in which was located an electric type-metal cutting machine, to which was attached a saw used in trimming the type-metal for the linotype machines. The scraps or trimmings fell to the floor under the machine, and plaintiff was required to remove them…
