—In an action, inter alia, to recover damages for illegal eviction, the plaintiff appeals from an order of the Supreme Court, Kings County (Jackson, J.), dated April 12, 2002, which granted the *494motion of the defendants Oriole Realty Corp. and Elliot Kalman for summary judgment dismissing the complaint insofar as asserted against them, and denied her cross motion for summary judgment on the issue of liability against those defendants.
Ordered that the order is modified, on the law, by deleting the provisions thereof granting those branches of the motion which were for summary judgment…
