SPEER, District Judge.

The question before the court is a controversy over the distribution of a fund to be paid by the government *335for the site of the post office building in Bainbridge, Ga. The lot has been purchased from Byron B. Bower and others, who are in possession. Upon investigation of the title, it appeared that a claim adversely to the vendors would be made to one-half of the purchase price agreed upon. The adverse claimants are the legatees under the will of B. F. Powell, deceased. In order to quiet the title, the government has instituted condemnation proceedings, and made service…
