THE COURT.

In this proceeding to compel arbitration under the uninsured motorist provisions of an insurance policy, the issues are (1) whether the application of the statutory time limitation of Insurance Code section 1.1580.2, subdivision (i), is a matter for the determination of the court when it hears a petition to compel arbitration under Code of Civil Procedure section 1281.2, or whether it is a matter to be determined by the arbitrator, and (2) whether the petition to compel arbitration was timely in this case.
