I.Background

In essence, this is an action for medical malpractice brought by plaintiff, Elayne Nascimento, and her children, Aya and Nea Nascimento, against Eleanor Caine, M.D. and Doctor Caine’s employer, Harvard Community Health Plan, Inc. (“HCHP”). In essence, Mrs. Nascimento alleges that HCHP and Doctor Caine negligently failed to discover and treat her breast cancer and that, as a consequence, she has suffered damages of various kinds, the precise contours and dimensions of which are here irrelevant.
