This is a motion by defendant to vacate and set aside a sentence imposed upon him as a fourth felony offender, on November 30,1953, in the Court of General Sessions and to be resentenced in place thereof, as a third felony offender.

The defendant-petitioner had pleaded guilty to the crime of attempted grand larceny in the second degree. Thereafter, an information, pursuant to section 1942 of the Penal Law was filed, which charged defendant with having committed three prior felonies.
