Petitioner was convicted in this State of the crime of manslaughter, first degree, a felony, and sentenced on April 28, 1938, to a term of from five to ten years. He was received in a State prison on April 29, 1938, with a credit of seven months and seventeen days jail time. On January 22, 1942, he was paroled and subsequently was inducted into the armed forces of the United States. On or about November 29, 1943, he deserted the armed forces and on or about said date, as was its right, under section 218 of the Correction Law of this State, the New York State Board of Parole declared him…
