ORDER ON TRUSTEE’S MOTION FOR TURNOVER OF EARNED BUT UNPAID WAGES

This matter comes before the Court on the Chapter 7 trustee’s (the “Trustee”) Amended Motion for Turnover (the “Amended Motion”) against Debtors Kenneth Randel Haraughty and Irma Robles Haraughty (“Debtors”). In the Amended Motion, the Trustee seeks turnover of wages that Kenneth Haraughty had earned but which had yet not been paid (the ‘Wages”) as of the filing of petition. Debtors seek to exempt all of the Wages pursuant to Indiana’s wage garnishment statute, Indiana Code § 24-4.5-5-105.…
