This appeal is from, a conviction of secqiid degree murder of Octavia Sellers, with a prison sentence of ten years. It is said that the evidence preponderates against tbe guilt of tbe accused, that tbe venue in Gibson County was not established, and that there was error in tbe charge. Also that tbe Court erred in failing to bear and act upon a plea in abatement raising tbe issue of venue.
