-We have before us an action in assumpsit containing three counts, all of which arise from the same factual background and all of which seek a common remedy.
From the complaint it appears that the two individual defendants, George W. Tule and Warren E. Mc-Devitt, Jr., were the developers of a certain tract of land known as “Crestview Manor”, located near Hummelstown.
