Before the Court is Plaintiffs’ Motion for a Preliminary Injunction (Docket # 6). Plaintiffs are state employees who have declined to become members of the Defendant Maine State Employees Association (“nonmembers” of the “MSEA”). Plaintiffs seek to enjoin the Defendants from collecting service fees from the named plaintiffs and others similarly situated. 1 Plaintiffs bring their claim under 42 U.S.C. § 1983, claiming that the procedure implementing the service fees is unconstitutional under Teachers Local No. 1 v.
