Discussing dismissal for lack of subject matter jurisdiction and remand.

This cause is before this magistrate judge pursuant to the parties’ consents and the reference of' the assigned district judge. 1 The Court sua sponte raised the issue of an apparent lack of subject matter jurisdiction and invited the parties’ advice. The parties submitted memoranda on the issue. For the reasons set forth below, the Court concludes that it lacks subject matter jurisdiction of this cause.
